Functioning of public electronic registers in martial law<\/u><\/strong><\/p>\n\n\n\n Martial law is imposed in Ukraine on February 24, 2022, at 5:30 a.m. in connection with Russia’s military aggression.<\/p>\n\n\n\n The press service of the State Judicial Administration of Ukraine of Ukraine reports that on February 27, 2022, a hacker attack was carried out on the web resource of the judiciary.<\/p>\n\n\n\n To prevent the threat to life and health of judges and participants access to the Unified State Register of Judgments, the services “Status of cases” and “List of cases to be considered” is temporarily suspended in martial law.<\/p>\n\n\n\n The issue of ensuring the functioning of information and communication systems, electronic communication systems, public electronic registers in martial law is regulated by the Resolution of the Cabinet of Ministers of Ukraine of March 12, 2022 \u2116 263, which allows ministries, other central and local executive bodies, state and municipal enterprises, institutions, organizations belonging to the sphere of their management, to ensure the proper functioning of information, information and communication and electronic communication systems, public electronic registers, owners (holders) and\/or administrators of which they are, and information protection, processed in them, as well as the protection of state information resources, take additional measures in martial law, including:<\/p>\n\n\n\n 1) to place state information resources and public electronic registers on cloud resources and\/or in data processing centers located outside Ukraine, and to register domain names in the gov.ua domain for such placement;<\/p>\n\n\n\n 2) to create additional backup copies of state information resources and public electronic registers in compliance with the requirements for integrity, confidentiality and accessibility established for such resources;<\/p>\n\n\n\n 3) to keep backup copies of state information resources and public electronic registers in encrypted form, in particular outside Ukraine, on cloud resources and\/or individual physical media, and\/or in an isolated segment of data centers in compliance with the requirements for such resources, confidentiality and accessibility;<\/p>\n\n\n\n 4) to suspend, restrict the operation of information, information and communication and electronic communication systems, as well as public electronic registers.<\/strong><\/p>\n\n\n\n On March 15, 2022, the Verkhovna Rada of Ukraine by a majority vote adopted as a basis and in general the Law On Amendments to Certain Laws of Ukraine on Ensuring the Functioning of Information and Communication Systems, Electronic Communication Systems, Public Electronic Registers, \u21167152. Law \u21167152 amends the Law of Ukraine On Information Protection in Information and Communication Systems and the Law of Ukraine On Public Electronic Registers and provides for:<\/p>\n\n\n\n \u2022 creation of backup copies of state information resources in compliance with the requirements established for such resources regarding their protection, integrity, confidentiality and their placement outside Ukraine;<\/p>\n\n\n\n \u2022 the possibility of placing information and communication systems, electronic communication systems, public electronic registers outside Ukraine.<\/p>\n\n\n\n The main purpose of the Law \u21167152 is a permission to create backup copies of state information resources and their placement outside Ukraine in compliance with the requirements for such resources for their protection, integrity and confidentiality, as well as the possibility of placing information and communication systems, electronic communication systems, public electronic registers outside Ukraine.<\/p>\n\n\n\n Chairman of The Verkhovna Rada of Ukraine Ruslan Stefanchuk has signed the Law \u21167152 and has sent it to the President of Ukraine for signature.<\/p>\n\n\n\n Despite limited access to the information systems of the judiciary of Ukraine, the courts continue to administer justice in an uninterrupted manner in the absence of threats to the lives and health of the parties to the case.
